Respondeat Superior

Respondeat Superior, Latin for “let the master answer”, is a doctrine of vicarious liability.  Under this tort, an employer may be held liable for injuries due to an employee’s actions if the employee was acting within the scope of employment.  To establish that the employee’s conduct was within the scope of employment ("Tort Liability", 2012):

(1)   The conduct must have occurred substantially within the time and space limits authorized by the employment

(2)   The employee must have been motivated, at least partially, by a purpose to serve the employer

(3)   The act must have been of a kind that the employee was hired to perform

Explain in essay form, how you believe this doctrine can affect pharmacy practice.  What research did you do to come up with this decision?  How might the pharmacist be affected under Respondeat Superior when, it comes to supervising technicians?  Come up with one scenario that could happen, within a pharmacy setting that might hold a pharmacist liable due to this doctrine.
